Kemp v. Keisha! What is the Latest?

By now I’m sure you have heard that Brian Kemp is suing Mayor Bottoms in response to her mask mandate in the city of Atlanta. Governor Kemp has also asked for the Court to order Mayor Bottoms to keep quiet about the lawsuit.

The hearing was scheduled for its hearing today at 11:00 am in front of Judge Kelly Ellerbe. Shortly before the hearing, Judge Ellerbe recused herself from the case.

Parties can request a judge to recuse themselves under certain circumstances. If there is any chance of bias or where a judge’s impartiality may be in question. Judge Ellerbe consulted with an Appellate Court Judge and decided to recuse herself.

The case was quickly reassigned to Judge Shawn LaGrua. Judge LaGrua also recused herself. She worked for Governor Kemp when served as Secretary of State.

Finally, the case was reassigned to Judge Jane Barwick who will need to re-schedule the emergency hearing. It should be soon. The hearing should be readily available to be streamed online.
